Feed, Fertilizer, Lime, Soil and Plant Amendments (FFLSP)

Under provisions of Mississippi laws regulating feed, fertilizer, lime and amendment products, the Bureau carries out activities that include registering products and facilities, collecting registration and inspection fees, inspecting and sampling products for label guarantees and assessing penalties for substandard products.

Product and Facility Registrations

All brands and grades of fertilizer, lime and soil/plant amendment products must be registered with the state agriculture department and the State Chemist before they can be sold in the state of Mississippi. Items subject to registration include liming materials, fertilizer materials, mixed grades of fertilizer and all products sold to promote plant growth by means other than supplying a recognized plant food element, or those products applied to plants, seed or soil to improve germination, growth, yield, product quality, reproduction, flavor or other desirable characteristics of plants.

Registration and Inspection Fees

All Fertilizer and Soil & Plant Amendment registrants are required to report tonnage of materials sold in the state to the department at the end of each state fiscal year. The reporting period runs from July 1-July 31 of each year. The fee for tonnage is .25 cents per ton for fertilizer sold in bulk or packages greater than 10 lbs and .35c per ton for Soil & Plant Amendments sold in bulk or packages greater than 10 lbs.

Product registration fees for fertilizers are $50 per product less than 10 lbs and $10 per product for greater than or equal to 10 lbs. Soil & Plant Amendment product registration fees are $75 per product less than 10 lbs or 1 gallon and $25 per product greater than or equal to 10 lbs.

Feed permits and products are renewed annually during the month of December. Feed permits are $100 per year. Feed product registration fees are $25 per product in packages less than 10 lbs. There is no product registration fee for products greater than or equal to 10 lbs but tonnage reporting is required annually for those products each January at .25 cents per ton.

There are no registration or tonnage fees for lime products, however, permits have to be renewed annually in June.

Penalties

The Bureau collects penalties assessed because of deviations that exceed permitted analytical variations from label guarantees on feed, fertilizer, lime and soil/plant amendment products. Penalties are also assessed for labeling, mishandling and adulteration of these products.

Penalties are also assessed for yearly tonnage reports not filed within the time period allowed by statute. All monies received are deposited in the General Fund of the State Treasury.
